THE APPROACH

Most mediations stall not because parties can’t compromise, but because no one has helped them realistically assess what continued conflict will cost them.  Eric’s approach is built around that reality.

Rather than simply shuttling offers between rooms, he brings the true cost of the dispute into focus, including financial exposure, time, distraction, and reputational risk, in a way that creates meaningful movement toward resolution.  It is not pressure.  It is clarity.

This framework, which he calls the RECO Method and has formalized in his book Beyond Tactics, grew directly out of hundreds of hours at the mediation table.  It reflects how he works in every case.

Parties in mediation are often operating in a high degree of uncertainty. One of the most valuable things a skilled mediator can offer is an off-ramp out of that uncertainty.

A negotiated resolution is defined, controllable, and final. A trial is none of those things.

The goal is not simply reaching agreement. It is helping parties move away from open-ended risk and toward a clear outcome that they understand and choose.

Eric Boughman brings something most mediators don’t: equal standing on both sides of the table.

He is recognized by Best Lawyers in America in both commercial litigation and corporate law.  That combination is uncommon. It means he understands how deals are structured and why they fall apart. He knows what a courtroom looks like from the front, and he knows what it costs to get there.  That dual perspective shapes everything about how he mediates.

Eric is an AV Preeminent-rated attorney, the highest rating issued by Martindale-Hubbell, and is noted in Chambers USA for commercial and corporate work.  He is a founding partner of ForsterBoughman, a business and tax law boutique in Central Florida, where his practice has centered on healthcare, technology, business disputes, and complex commercial matters for more than two decades.

He holds a Certificate in Mediation and Conflict Management from Harvard Law School’s Program on Negotiation, and he is a Florida Supreme Court Certified Arbitrator, an American Health Law Association Arbitrator, and a FINRA Qualified Arbitrator.  He is also available as a special master for discovery disputes and private hearings.

Since 2022, Eric has mediated more than 180 disputes, with particular depth in healthcare and medical practice matters, technology and licensing conflicts, and partnership and shareholder disputes.  These are complex, high-stakes matters where subject matter knowledge and strategic perspective directly impact outcomes.

He also regularly mediates across the broader range of business and commercial disputes, including fiduciary matters, contract disputes, employment issues, real estate matters, and other conflicts arising in closely held and professional businesses.

He is a frequent speaker and educator on negotiation, dispute resolution, healthcare law, technology, privacy, and legal ethics, addressing bar associations, professional organizations, and industry groups across Florida and nationally.  His written work has appeared in Forbes, The Florida Bar Journal, Law360, Kiplinger, and multiple American Bar Association publications.  He is a contributing author to the ABA’s publication on The Law of Artificial Intelligence.

Eric earned his law degree, magna cum laude, from the University of Minnesota Law School, and a post-graduate Certificate in Health Care Law from Brandeis University.  He currently serves as President of the Seminole County Inn of Court and as General Counsel to Rotary District 6980.  He has served as Vice-Chair of the Eighteenth Judicial Circuit Grievance Committee and serves on the Eighteenth Judicial Circuit Unlicensed Practice of Law Committee, both Bar appointments.

He is a recipient of The Florida Bar President’s Pro Bono Service Award and has been recognized by the Seminole County Bar Association Legal Aid Society as Pro Bono Attorney of the Year.

Eric is a proud veteran of the United States Air Force.

 

WHAT TO EXPECT

Eric mediates in person in Central Florida and remotely via Zoom or Teams.  Sessions typically run four to ten hours.  He is available for half-day, full-day, and multi-session engagements, and can accommodate complex or multi-party disputes requiring extended schedules.
